Cheech and Chong are comedians that were popular during the 1970s for their humor and "Earache My Eye", a song making fun of fathers, sons, and Alice Cooper clones that cross-dress. I suggest that you listen to them before you go to your Blockbuster and rent "Up In Smoke" or "Nice Dreams" because you'll understand the jokes a lot better if you listen to their albums.

If anyone should be pissing over this it should be Neopets, as they have actually PAYED for legally binding copyrights of the characters that Tomi so eagerly claims are his. I can put any name I want on a Squirrel or Dog Neopet, but the Neopets organization themselves still own the characters, and ALL rights to the character under their respective patent.
Consult the extended terms and conditions for the Neopets site for details on all that, but trust me β thereβs nothing any of the people on this or any other site on the net can do to sue you for characters they themselves have stolen, nor can they claim ANY legal ownership over things you or I could just as easily have created.
Unless Tomi manages to beat you to the patent office for the contracts, and doesnβt end up in prison for his existent violations; you may consider disregarding the claims made in his argument.
Morality is the only thing that should sway your decisionβ¦

What is (in fact) against any law in this argument is the fact that Tomi has claimed ownership over characters he owns no actual copyright for, and is attempting to use this non-existent right to patent as leverage for cease and desist.
Just because you draw something does not mean you can claim private ownership over it any further than it exits your computer. Once itβs out for the world to see, and youβve got no legally binding ownership over it (certified BY LAW); it can be subject to any manner of use without your permission. The only thing keeping most of us from misusing this fact is our checkbox agreements to deviantart, and to our fellow artists.
I dare you to make a court case about this situation β false copyright is the only credible action, and theyβll only attack Tomi for the grievance.

Actually, I wrote the story on Fanfiction.net, which is a website devoted to being like Negativland (famous "copyright infringers"; believe in Fair Use Doctrine), when it comes to writing stories based on copyrighted characters. That's what I mean. He can't actually sue me just because I make a song titled "Braylo". If he did, he would be sent to jail. Braylo is a weird, yet sort-of-common name, originating in Israel.
Main authors, like Anne Rice, the Archie publishers, and George "Jerk of the Week" R. R. Martin, can't take it when they read a fanfiction of their characters and will try to destroy you, but look at the guys who wrote the play about Archie being ! Archie needs to adjust to the time or else Negativland may make an album based on this whole thing, like with David Brom and KPIX News in San Francisco.
It's like this. Negativland steals audio and so did the Beastie Boys (to make "Escape From Noise" and "Paul's Boutique"), but they didn't get sued. MCA, Adrock, and Mike D. don't use samples anymore because they are afraid that they might get sued (and they they play regular instruments now, like in the very early 1980s), but Negativland's "No Business", released in 2005, their new album, has about twice the samples but no lawsuits. You can't protect your items. You have to share some.
In fact, he says that I put him and his mom in the story. Well, the reason is because he is a main star and plus, I wanted to put Leslie Fram, albeit disguised as a mom, in there. He soon got angry at me and told me to delete it. I told him I'll try to rewrite it, but then he says, "Heck no! You can't rewrite it with MY CHARACTERS!!" They're just copyrighted Neopets with your designs and your names, duh! I'm not trying to make you mad like Third Day, but you have to let people use your mom, you, and your characters if you want to go somewhere! If you keep on trying to protect, you'll get nowhere. Archie Comics readership has gone down because of the no fan works policy. Soon, you may experience the same.
Did Cheech and Chong get mad when people used Pedro, Man, Sister Elephant, Evelyn Woodhead, and Stadanko in fanart and fanfiction? No! They sat back and read it.
I can see why the VAs for Code: Lyoko don't read fanfics. They need to play the character and not mix it in with all this fanfiction stuff. (And plus, Matthew Gecze didn't like one because of the OddSissi combination.)

For one thing, he "outgrew" Neopets, so he quit drawing Braylo and other classic characters, but then he didn't stop with Yellow, Right, and Kevin, because they all can be in a separate series without having Yellow's family collide (just think of that; glad he didn't do that).
Also, he makes other animations, like At Your Service and ToonOUT, which are parodies of coffee shops and reality TV shows

Hey, Tomi. I'm nearly2pac and I'm a very big fan of your old "Pet Patrol Revolution" series, remember, with Braylo and Lucy. Why'd you cancel it? Why'd you decide not to put Braylo in "Happy Endings"? Isn't he important? Well, if you can, try to use the "La la la...stupidity" designs for the characters if you want to draw a comic on Braylo's life.

I kind of outgrew Neopets, and Yellow is the only one who managed to establish herself as a more-than-neopets character before the comic ended.
Also, the animations were about Yellow's love life, nobody from her family has been put int he story. Not ot mention the plot is based on certain songs, which dictate what goe son, and they dont mention family

I don't go on fanfiction.net, and I never ehard of Eyeball skeleton. It's just that one days someone IMd me saying they stumbled across a fanfic about my characters and linked me to it.
However, while I was extremely flattered you liked my characters enough to make a story about them, and I thought your story was very interesting, I think there are things you could have done to make the story better.
Please don't take this in an offensive way, I dont mean to offend, I'm just telling you about what I thought.
For example, you had my characters and me do very strange things, and you involved my mother in the story, without asking for permission on either, not to mention you mentioned our full names.
You included things in the story that would usually be considered mature content, which I found to be inappropriate, and there didnt seem to be just one story going on, it seemd to be more like a random dream.
However, I did like your creativity alot and I think that with some work you can really write great things, especially if you ask for permission and check in with the people who youre reffering to.
