The next installment of the Art Thief Tutorial "Sexy Art God" series. Today's episode is about Orphan Works! Yay!

And here is Mr. Textwall, with the disclaimer.

Information in this satirical work may or may not be accurate. The Orphan Works bill does exist, and there are many interpretations of it.

I prefer the proposal brought by the ASMP [link] , and hope the bill is narrowly construed to exclude orphan works in a commercial setting.

I do understand the intent of the bill, but I do worry that if it's not properly worded, savvy art thieves will be able to use it to their advantage in regards to lesser-known or foreign artists.

I think it may have been an Oliver Twist reference.

Oh, I feel your pain. Well, not really, because I've never had my art stolen from me like this, quite fortunately, but I think the orphan works bill is ridiculous, too. I GUESS I understand placing "orphan works" in a library, since I know there are sections for unpublished work and stuff, but... I just don't like this orphan works stuff one bit.

Glittercandy In reply to DestyPanthera [2010-06-03 01:05:21 +0000 UTC]

I don't think it ever passed, and it's hard to say if it ever will. But they could always do a library-specific sort of thing...

I haven't seen anything on this since I first heard rumblings about it... did it pass as written, or should I just google to save you time?

I haven't heard about it in some time either. I think if it did pass, the entire internet would have complained about it.

God, this is such a stupid act...I haven't been able to find any recent data on it, though. I looked at a Wikipedia article and it said that it was updated about 2 days previous to my finding it...but it didn't say anything more recent that 2008.

I mean, it's just a way for corporations to skimp out on a couple bucks - truth be told, anybody can be a lawyer or a buisnessman, but it USED to be -coughTwilightRuinedItcough- that being noticed as an artist took real talent. Now, people want to sap the diligently constructed artwork out of the minority of actually DECENT artists for free because they think they have the right to. Bullshit! Artists can't all be fucking starving!

Sorry for going off on a rant, but hearing that this law is either in effect or being considered...or even WAS considered...just proves to me that America is becoming a place of money, not a place of equality and freedoms like it was first intended to be.

~Bring America Back!~

And I love it...very nicely constructed ^^

...I think it's dead. For now anyway. The last I heard of it was from the bottom link and I think if it had made it through, there'd have been an uproar of rants.

Actually, there is an image search engine now. It's called TinEye: [link]

Feed it an image and it'll look for duplicates on other sites. Of course it doesn't know every single image on the net, but still...

Thanks for the info on the Orphan Works bill. (I actually read the entire damn thing and realized that I was unintentionally doing a similar action on a piece of artwork I got permission to edit. I'm starting over with that piece.) I didn't know it existed. Nice dose of humor you injected into it, though.

You should consider doing a follow-up to your Mary-Sue tutorial sometime... Maybe an Original Character parody tutorial? Just a thought.

Look at the people REALLY pushing for this bill. I don't understand, if so many people are "unconcerned", then why are they getting all steamed up because I don't want to have to deal with registries or chance having my work used as an orphan (reasonable compensation doesn't make a bit of difference to me if I didn't want my artwork used in the first place). Also, as almost any of us know, you can spend a lifetime right now trying to catch up with all the flakes that want to sell your artwork on Photobucket, ebay, cafepress, zazzle or any of those many sites.

From ARTWANTED's image upload
"Digital Artwork Understanding
By posting your artwork on the Internet, you acknowledge that by doing so, allows anyone to download, print, screen-capture and digitally edit your image. This also allows websites such as 'Google Image Search' to take the artwork from this site and add it to their image search functions without credit to the artist. If this concerns you, then you should not post your artwork anywhere on the Internet or you can place a large visible watermark/copyright sign on all your artwork. This will discourage cyber thieves from stealing your artwork."

Gee, I wonder if AW gets a fee for allowing the images to be used....and notice it specifies "WITHOUT CREDIT".

Google this up...ORPHAN WORKS +
Microsoft wants to buy Yahoo - who incidently owns Flikr.com -
([link])
and they (microsoft) are already working with Picscout
([link]) and they, MS, hired Jule Sigall who was the man that wrote the ORPHAN WORKS REPORT while he worked for the COPYRIGHT OFFICE.
([link]rintable=yes (Tech Law Journal's owner Mr.Carney wrote, "The primary author of the report, Jule Sigall, subsequently went to work for Microsoft. See, story titled "Jule Sigall Joins Microsoft" in TLJ Daily E-Mail Alert No. 1,510, December 27, 2006.")

Then Google has problems with MS, because MS has issues with how Google deals with copyright issues...or maybe because of competition over ads (Google is way out front) - part of the reason everyone is fighting over the images in my opinion...we all search the net, they throw the ads in on the side and that's how they make their money - not to mention what they'll make off registration and searches as well. "Companies that create no content of their own, and make money solely on the backs of other people's content, are raking in billions through advertising revenue and IPOs. Google takes the position that

everything may be freely copied unless the copyright owner notifies Google and tells it to stop. "

That sounds familar....[link] & ([link] )

Google is hooked up with Getty and AOL (Shawn Bentley went from the US gov. to work for time warner - owner of AOL - as VP of IP and Global Public Policy after he worked in the senate and "helped write are among the most important laws in the intellectual property world: the Satellite Home Viewer Improvement Act; the Digital Millennium Copyright Act, the American Inventors Protection Act, the Patent Fee Integrity and Innovation Protection Act, the Anti-Counterfeiting Consumer Protection Act, and the Trademark Dilution Act, just to name a few.” [link]

Then there's apple fixing to jump into the mix?([link])

I was fairly mobbed here for even posting anything 'ANTI' orphan works - like alot of the other people on this site seem to have been also. If some one else is not 'WORRIED' about the bill and its no big deal, then why are they freaking out of their heads about the fact that I am VERY concerned and choose to post some information from Reliable Sources? Makes me wonder....

Although this is a serious thing, the Orphan Works act, I love the humor added to a usually horrifying subject.
"Sexy art gods..."

P.S. I'm actually doing a paper about this act, and I was wondering if I could possibly use this as comical part of my presentation for English (ALL credit going to you, OF COURSE! Because I cannot handle the awesome skills of a Sexy Art God). If not, that's fine; I had a good laugh.

Yikes. Congress is so good at leaving loop holes, I mean interpretations that can be used by the public. I wonder how an they would handle an American artist having there work stolen by someone outside the jurisdiction of the U.S. Go through the U.N. maybe? Yeah, I can totally see that happening...
