Did you ask Apple for permission to use their image? And for that matter claiming it as your own?
you give people a hard time not to use your stuff, why then decide to use a brand name stuff without permission?

I don't know, that is up to you. You can use it to make a wallpaper, on your website, etc. just nothing commercial.
