What's this About?

You don't feel bad using someone else's pretty photo or kawaii anime artwork for your graphic design? Because it's copying, not stealing? Right? But you're not just making a copy of the file! You're leeching off someone else's talent without them knowing!

Artists have the same intellectual property rights online as they do in real life. And just because it's easy to get away with it on the internet, doesn't mean it's ok to do!

IT FEELS GOOD to know people want to use your artwork for a web/graphic design. But it's annoying to have it done without your awareness.

Ask permission! Communicate! Make an artist happy knowing you like their work! Make yourself happy knowing the artist is ok with you've done with their work!



MISCONCEPTIONS

Purchasing a book, game, music or DVD, does not grant you the right to copy its content online. These products come with a license limiting what you can do with them. Often the author states inside the cover they do not want you re-using their work!

Crediting or disclaiming does not equal permission. It doesn't clear you of doing anything wrong.

"Credit to whoever" or "this isn't mine, I found it on the internet", is not the correct source to credit. Also,Β it doesn't help anyone - you might as well say nothing.

"Credit goes to Google" or "Credit goes to -xyz- scans gallery", is not the correct source to credit.

You are not allowed to put "Copyright (c) Me" on something you upload to the internet if it's mostly made from other people's work.



Getting Permission is Not Difficult

If you can take an hour to create a wallpaper or something, surely you can spend 5 minutes sending an email or letter asking permission.

I try to avoid breaching copyright as much as I can.
A friend wanted to make a journal skin for me, and I wanted it to have a specific character on it, but instead of using an image that somebody else had done, I drew the character myself.

I just don't understand why people think art theft is okay, and do it without feeling as though they've done anything wrong... ?

Thanks. Although personal blogs/sites aren't such a big deal, it does feel "more personal" if you use your own stuff.

People don't feel wrong because "making a copy isn't stealing".

Thank you for the FAQ links on the Submission Policies. I find the issue of copyright one that is very hard to be 100% pure in, due to the pervasive nature of intellectual property in this digital age. Everything is easily "grabbed". Growing up with the internet and its capabilites, I have had to learn what is wrong, even though it can be done with a computer, and seems to be encouraged to be done (e.g. downloading images....as a young boy I didn't see anything wrong with d/l and printing images I saw online...there were options to do so and so I did...but now I know more and more about copyright). I will use these links in an effort to further respect copyright. I have favorite-ed the stamp because I understand and agree, and wish to look back on this from time to time as a reminder and aid to keep making sure of what is acceptable.

By the way, there is absolutely nothing wrong with downloading and printing images found on the internet... unless you're selling the copies.

It's just unfair to earn fame or money from someone else's work without them being a part of it.

Though my art's not that good and no one steals it I can definately see the artist's side, you don't spend hours doing a picture just for someone to steal it and have people crediting them!
I've personally seen a few people steal art for some reason or another.
Someone went onto Google, found some picture and was gonna use that character for their own. And when I found out, I gave them a huge rant because they did not plan to even give credit.
Not to mention one person found a picture that was very detailed and looked like it had taken hours to draw and he lied saying it was his. And he was doing this on my site too, the other admins and I were so mad about his lie that we told him next time he steals art he's banned from our site.
It may not fix the problem completely, but at least there are many who agree with you.

no i agree, its just that its one thing to say you can support it, but its another where circumstances cant allow you to follow through, and sometimes i feel awful about it not being able to follow through

like you say you should always get permission, and i TOTALLY agree... but its hard getting in contact with people and the RIGHT people when you want to borrow their work...

all i can do is give credit, and however this stamp and the explanation behind it says its not enough, and i feel bad that giving credit is all i can do and thats how far my feet can take me... even if its for something like this...

That's ok.

There are some people who are near-impossible to contact - Those are usually the big companies. The big companies usually don't mind re-use without permission.

But on deviantART, things are different. It's site policy to have permission for everything. I like to make sure I'm following the rules here.

I don't mind people re-using official images and celebrity photos outside deviantART, as long as they credit properly. (Not Google!)

However, if it's an independent artist or small company, I will try to help them out.

How in the hell is someone going to ask permission to draw/use something if they live in a totally different continent? Or what if they're dead? I'm not going to go alllll the way to Japan just to ask Satoshi Tajiri if I can draw his Pokemon.
So we give credit (ex. Pokemon (c) Satoshi Tajiri / Nintedo), sometimes people already know who it belongs too.

If the person is dead, you wait 70 years and then the copyright is clear. UNLESS the rights were passed on to their children, company or bought by someone.

Ask someone in another continent? Well there's email. Or writing a letter. They do get those in other countries. If you send someone a formal letter/email (especially if they see "Pokemon" or their name in it several times) chances are they'll want to know what it says and translate it.

Fan art (if this is what you're talking about), is technically copyright infringement. But generally speaking, the big and famous people like it, so it's not a problem to them. If Tajiri/Nintendo didn't like fan art, they would make some big public notice about it.

If it's not someone big, like a deviantART artist, they'd probably want to know if you wrote fiction or drew something with their OCs. Because it's courtesy, and because they are not big and famous they probably DO want to know about every little bit of attention they get.

70+ years after the creator dies, it becomes public domain. Unless the creator gives the copyright to someone else before they die. There are tons of free images/videos/etc which have expired copyright and have become public domain.

Find a mail/email address? Every artist should have some form of contact easily found. Try their website?

Recently I had an EX friend steal a roleplay character and their storyline from me and it was a very irritating experience and I would have stopped at nothing to make sure that they didn't get away with it. Internet theft is very, very pathetic. It shows lack of self confidence, a level of lowness, that you have no morals, well, all in all, it's really pathetic. At least, the least the could do is say who was the original artist, if they don't tell the artist themsel. But written permission IS necessary and really, it's borderline against the law when they steal something.
